1. Relationship to Client Service Agreements
This Site provides informational resources regarding our personalized, human-curated matchmaking and introduction services and allows prospective clients to request consultations. Accessing or submitting an inquiry through this Site does not constitute a binding agreement by Duet Concierge to provide matchmaking services.
Formal matchmaking services, fees, scope of service, refund terms, and client obligations are governed exclusively by a separate, legally binding Matchmaker Service Agreement executed between you and Duet Concierge Limited via electronic signature (e.g., DocuSign). In the event of any conflict between these Website Terms and an executed Matchmaker Service Agreement, the terms of the executed Matchmaker Service Agreement shall control.
2. Eligibility & Mandatory Duet App Account Requirement
By using this Site or submitting an inquiry form, you represent and warrant that:
- You are at least eighteen (18) years of age;
- You have the legal capacity to enter into a binding contract;
- You are currently single and legally free to pursue personal relationships; and
- All information you submit to us is accurate, truthful, and not misleading.
Mandatory Duet App Account: Receiving matchmaking services through Duet Concierge Limited requires that you register and maintain an active user account on the Duet mobile application (“Duet App”), operated by our corporate affiliate, Wink Tech Limited. Because our client relationship management infrastructure and platform authentication systems are integrated with the Duet App backend, your Duet App account serves as the underlying technical platform for identity verification, profile presentation, and communication integration. Use of the Duet App is subject to Wink Tech Limited’s Terms of Service and Privacy Policy.
3. Communication Consent & TCPA Disclosure
By providing your phone number and email address through our website intake forms, you expressly consent to receive service-related communications, appointment updates, consultation scheduling, and promotional messages from Duet Concierge Limited via email, telephone calls, SMS/text messages, and messaging platforms.
- Automated Technology: Where applicable, you consent to receiving communications using automated dialing systems or pre-recorded messages in accordance with the Telephone Consumer Protection Act (TCPA).
- Marketing Opt-Out: Consent to receive marketing communications is not a condition of purchasing any service. You may opt out of SMS messages at any time by replying “STOP” or opt out of promotional emails by clicking the “Unsubscribe” link.
4. Intellectual Property
All content on this Site—including text, software, logos, trademarks, graphic designs, images, and brand materials—is the property of Duet Concierge Limited or its corporate affiliates (including Wink Tech Limited) and is protected by United States and international intellectual property laws. 5. Acceptable Use and Prohibited Conduct
You agree to use the Site solely for lawful, personal inquiries regarding our matchmaking services. Duet Concierge Limited enforces a strict zero-tolerance policy against unlawful, harmful, deceptive, or abusive conduct. You expressly agree that you will not use our website, consultation channels, or matchmaking services to participate in, facilitate, or assist with any of the following prohibited activities:
- Human or Sex Trafficking: Engaging in, facilitating, encouraging, or assisting with human trafficking, sex trafficking, involuntary servitude, or labor exploitation of any kind.
- Sexual Violence & Abuse: Committing, threatening, inciting, aiding, or abetting sexual violence, sexual assault, non-consensual sexual acts, physical abuse, domestic violence, harassment, intimidation, or stalking.
- All Sexual & Sexually Explicit Content: Creating, uploading, requesting, soliciting, or distributing any and all sexual content, sexually explicit materials, pornography, adult media, or intimate imagery of any kind, entirely regardless of consent.
- Child Sexual Abuse Material (CSAM) & Exploitation: Creating, possessing, distributing, soliciting, or accessing Child Sexual Abuse Material (CSAM) or participating in child sexual exploitation and abuse of any kind. Zero tolerance is strictly enforced, and violations will immediately be reported to law enforcement and the National Center for Missing & Exploited Children (NCMEC).
- Romance Fraud & Financial Exploitation: Engaging in romance fraud, financial scams, deceptive solicitations, requesting money, gifts, or cryptocurrency from other users, or misrepresenting your identity or intentions for financial gain.
- Impersonation & Deceptive Profiles: Impersonating any person, entity, or representative, providing false, misleading, or deceptive personal details or background information, or creating fraudulent profiles.
- Scraping & Automated Tools: Using automated tools, scrapers, web crawlers, spiders, or bots to extract or harvest data, profiles, or content from the Site.
- Security Integrity & Hacking: Attempting to bypass, breach, probe, or compromise the security features, authentication measures, or underlying infrastructure of the Site.
- Unauthorized Commercial Use & Spam: Using contact details or information obtained through the Site to solicit users, send unsolicited commercial advertising, spam, or harass others.
- Illegal Acts: Engaging in, facilitating, promoting, or committing any illegal acts, unlawful activities, or violations of applicable local, state, federal, or international laws or regulations.
Violation of any of these prohibitions will result in immediate termination of services, permanent ban, and referral to law enforcement authorities where appropriate.
6. Disclaimer of Warranties
The Site and all content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. Duet Concierge Limited disclaims all warranties, express or implied, including MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, and NON-INFRINGEMENT. We do not guarantee that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Duet Concierge Limited, its affiliates (including Wink Tech Limited), and their respective officers, directors, employees, agents, or representatives shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of or inability to use the Site. Our total cumulative liability for any claim arising under these Terms shall not exceed $100 USD.
8. Binding Arbitration and Class Action Waiver
- Good-Faith Resolution: Any dispute or claim arising out of or relating to your use of the Site shall first be submitted to Duet Concierge Limited for informal resolution by contacting support@duetconcierge.com.
- Binding Arbitration: If unresolved within thirty (30) days, the dispute shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Class Action Waiver: You and Duet Concierge Limited agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to conflict-of-law principles.
